DEFINITION

The “Seller / We / Us / Our'' is defined as the legal entity A Luxé Cake Studio. The “Buyer / You” means the person/s who buys the Cake, Confections, or other Products sold on the website.

The Seller and the Buyer are collectively referred to as the Parties.

“The Product” is the cake/cakes/patisserie/products to be supplied by the Seller to the Buyer and as described in the invoice accompanying these terms and conditions.

“The Event” is the wedding/celebration/occasion that the Product is required for.

 

GENERAL

This Agreement forms the entire agreement between the Parties. 

We reserve the right to refuse service to anyone at any time.

 

PAYMENTS & DEPOSITS

We accept debit or credit only. No cash or checks will be accepted. All orders require an intake form following a 50% non-refundable reservation deposit. ALCS should receive the balance within the following time frames: Reservation deposits should be received within 24 hours of invoice receipt. Final payment is due fourteen (14) days before delivery or pickup of the items ordered. ALCS will charge a 25% late fee each day the final payment is late; after two (2) days of no payment, ALCS will cancel your order with no refund or store credit.

CONSULTATIONS

Consultations are by appointment and for weddings only. An appointment for a consultation and tasting must be agreed upon with A Luxé Cake Studio by email, and the client must pay before ALCS can confirm the consultation. ALCS will confirm all appointments in writing via email.

REFUND

We take pride in all of our cakes and confections. If you are unhappy with your order, immediately notify us via email (within 24 hours of pick-up) with your concerns. A Luxé Cake Studio has up to 14 Business days to review this request and determine an outcome. The outcome will be sent to the email address of the requester. IN THESE CIRCUMSTANCES, THE CAKE MUST BE RETURNED IN FULL. WE ARE STRICTLY UNABLE TO ISSUE A REFUND FOR A CAKE OR PRODUCT THAT HAS BEEN CONSUMED.

All sales are final, and all payments are non-refundable. Store credit and refunds can only be issued if A Luxé Cake Studio causes an error. If shipments are delayed, products are delivered broken or missing, etc., ALCS cannot be held liable for these mishaps. We will do our best to accommodate this problem by giving other alternatives. ALCS will issue no refund.

The initial deposit that reserves your event date is non-refundable but transferable up to the conclusion of the current year, excluding wedding cakes. It’s monetary value cannot be applied to store credit. When we accept your order, we begin limiting our availability and gathering the necessary tools to complete your order. As we get closer to your event date, the chances of re-booking your date are significantly reduced.

DESIGN PROCESS

We are so happy to be considered as your baker of choice. We hope you have chosen us because you love our style, aesthetic and creativity. Due to the nature of the creative process, we do not copy or replicate other artist’s work. we may use your inspiration images as inspiration only. we will do our absolute best to communicate with you to give you a cake that you’re going to love.

Please consider booking a custom cake similar to our artistry and past designs. Our style of cakes is buttercream cakes with lots of texture and fresh floral or fondant accents. We do not create sculpted cakes , and novelty cakes are approved case by case.

CELEBRATION ORDERS 

For custom celebration orders, please ensure you place your order at least two weeks (2) from your requested pickup or delivery date. ALCS may decline orders outside our desired time frame due to our limited availability.

WEDDING ORDERS 

Orders placed less than eight weeks before the client's delivery, or pickup date must be paid in full. Failure to pay the final balance by the date stated on the invoice may result in the Buyer’s order being canceled and no refund given.

We can reschedule your wedding cake at no additional cost, ONLY if you contact us at least fourteen (14) days before your wedding date; anything less will result in a 25% reschedule fee. Further, NO rescheduling is permitted if less than seven days' notice is given. Seven days is the bare minimum amount of time needed for planning and preparing for large wedding orders and the delivery/set up for those. 

We will NOT provide a credit for wedding orders other than giving the exact order/cake on a new date. The client must provide sufficient notice of the new date to allow us the ability to accommodate the order. 

CANCELLATIONS & ALTERATIONS

The final date for any changes to the size, flavor, style, etc., of the cake is due one week before the fullfilment date. Any changes after this date cannot be guaranteed and may be subject to additional charges. The client must submit any changes in writing via email only. Changes communicated via phone, social media messaging, text, etc., will not be honored. Seasonal items may incur an additional charge or may be substituted if unavailable.

Orders paid in full and canceled with more than two weeks' notice will receive a store credit of 50% of the total amount paid, the deposit fee is non-refundable. If we have to cancel your order for any reason, we will give you as much notice as possible, discuss the matter with you and try to agree to a suitable alternative. If you are not willing to accept our suggested option, then we will refund the total price to you.

PICKUP & DELIVERY

ALCS will have your order ready for the pickup time listed on your inquiry form. Delivery is only available for weddings or orders over $500.

Cakes may be set up 1-3 hours before your event. For outdoor events, we try to set up as close to the event/reception time as possible, which may limit design options. 

The Client must disclose any adverse road hazards and obstacles that may hamper the delivery and quality of finished products.  In the case of an unavoidable occurrence, such as an act of god, a car accident, or poor road conditions — A Luxé Cake Studio cannot be held liable. However, we will do our best to deliver your goods if the weather permits. 

If the client or client representative is not available to receive the delivery, A minimum $50.00 re-delivery fee will be required at the time of receipt of goods and services. 

The pick-up time input on your inquiry form will be your pickup time, please set your pickup time accordingly. This lets us plan our strict schedule to complete our cake orders on time. If you need to pick up your order earlier than you intended or on a Sunday or Monday, please get in touch with us immediately so we can ensure we will complete your order in time.

Please make sure to pick your cake up before our closing time. We understand that emergencies arise and are willing to accommodate those times as much as possible. However, we cannot guarantee staff availability for an after-hours pick-up. Further, this will only be available if we are contacted before closing!

Curbside Cake Pickups are located in DeSoto and scheduled on the following days/hours, based on availability..

Tuesday-Friday: 1:00-5:00pm

Saturday-Sunday 11:00am- 1:00pm

Monday: Closed - No pickup on this day

CLIENT RESPONSIBILITY AND TRANSPORTATION

*PLEASE NOTE: All of our cakes and cupcakes are stored in a refrigerator at our studio. They will be cold when you pick them up, as this allows for better and safer transport.We recommend you also store them in your refrigerator until about 2-3 hours before serving.*

  • All products are the client’s responsibility upon leaving the bakery unless we deliver them.

  • Keep in mind that cakes are very fragile, and damages can happen if not handled properly – such as cracks, smudges, melted frosting, etc.

  • Please drive carefully, keep the cake lying flat in the car, and keep it in an air-conditioned climate

  • Texas summers get highly humid and hot, and both are hard on cake and icing. We keep all orders refrigerated and recommend that clients do the same, especially during the hot summer months.

  • DO NOT leave the cake outside at any time, even for a party. It will melt and can melt in less than 20 minutes at higher temperatures.

  • DO NOT PLACE YOUR CAKE IN THE CAR SEAT! It is NOT level or flat! Doing so will cause the cake to slide and be damaged.

  • Do NOT leave your cake in the car while running into the store for balloons or other items, even if it is only 50 degrees outside! If the sun is out, your car's interior is likely much warmer than that, and the cake will melt!

  • Do NOT place your cake on the counter near your stove, and then use the stove for cooking food! Although keeping many types of cakes at room temperature is perfectly okay, the heat or moisture from the stove will cause the "room" temperature to rise and the cake/frosting to melt and fall apart!

  • Do NOT place your cake in a "sun-lit" area, Even when left on a table or counter in a climate-cooled room. If sitting in direct sunlight from a window, a cake will get too warm and melt over time.

 If you are unsure of the proper transport and care of the cake, please ask!

CAKE DAMAGES

WE WILL AIM TO PROVIDE AS MUCH DETAIL AND ASSISTANCE IN RELATION TO BEST STORAGE FOR YOUR ORDER. WE TAKE NO RESPONSIBILITY IF A CAKE IS DAMAGED AFTER IT HAS BEEN PICKED UP BY THE CLIENT OR A DESIGNATED PERSON, OR, DELIVERED TO THE CLIENT’S ADDRESS OR EVENT SPACE. 

REVIEWS

You acknowledge that we may publish any review, feedback, or rating you leave on the Website. You agree that it may be displayed for as long as we consider appropriate and that the content may be syndicated to our other websites, publications, or marketing materials.

We reserve the right to publish, edit or remove any reviews

FORCE MAJUERE

We shall have no liability for delays or failures in delivery or performance of our obligations to you resulting from any act, events, omissions, failures or accidents that are outside of our control (‘Force Majeure’), which, without limitation, include: Strikes, lockouts or other industrial action; Shortages of labor, fuel, power, raw material, Late or defective performance or non performance by suppliers; Private or public telecommunication, computer network failures or breakdown of equipment; Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or extreme weather conditions; Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; Acts, decrees, legislation, regulations or restrictions of any government; and Other causes, beyond our reasonable control.

Our performance will be deemed to be suspended for the period that the event or Force Majeure continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to minimize any delay caused by Force Majeure or to find a solution by which our obligations may be performed despite the Force Majeure event. We shall promptly notify you of any Force Majeure event giving details of it and (where possible) the extent and likely duration of any delay.

Where the period of non-performance or delay concerning any event of Force Majeure exceeds 30 days from the date of notice to you of the possibility of Force Majeure, either you or we may, by written notice to the other, terminate the Contract with immediate effect upon service.
